Personally appeared before me Ebenezer Currier Esquire one of the Judges of the Court of Common Pleas for said county of Athens on this 18th day of January 1822. Joseph Dana of said Athens who having been duly sworn by me according to the law on his oath declared.
     That on the sixth day of February 1819 William Bodwell applied to the said deponent to purchase for said Bodwell and one John Brice brother to said Bodwell's wife the North West Quarter of Section numbered 35 in Township 4 Range 13 in the Ohio Company's Purchase.

Note Note(s): at Ohio There are no John Brice's in the 1820 census (time of Wm Bodwell's transaction with John Brice/Price) but there IS a John Price the right age (1m26-45, 1f45+ and 1each 0-10) in Athens Co. Maybe he is the John D Price who died 11 Oct 1850 Warren, Belmont, OH. His estate is listed as 1851 estate # 02716 (not on film at SLC) (*see below). Another convincing factor is that her son's middle name is Price, and though the 1839 deed first refers to her brother as Brice, later in the document it says Price.
No Brice or Bell candidates (in other words, right dates) in the probate indexes for Belmont Co that start in 1800 (SLC 213623). However, there are Prices - Samuel Price wife Sally had dau Mary but wrong one. Possible brother Willam died 1794 Sussex NJ, m to Sarah Hall, had dau Elizabeth 1787-1865 who marr Wilhelm Jacob Lash - and Elizabeth (Price) Lash is buried in Bassett cemetery.
Athens - land - no leads in index for either Brice or Price
Athens - probate - James Brice bk 2 pg 138 and Thomas Brice bk 3 pg 32. No Prices.
James Brice leaves wearing apparel and the watch he wears to son John. Everything else to wife Anna. No mention of other children. Witnesses include Joseph Dana, Joseph Dana Jr, and Robert Sanderson - hmm, Joseph Dana is the one who Wm Bodwell had the land agreement with. 17 Nov 1832

He left first family and split for Ohio in 1800. He divorced or made a bigamous marriage with Mary Brice, unclear which. Marriage info from Geoffrey Bodwell who also says she married first a Bell.

     Know all whom it may concern that we Sarah Bell, Michael Swain and Nancy wife of said Michael in the right of said Nancy, Enoch Bodwell and Elizabeth wife of said Enoch in the right of said Elizabeth, Samuel Armstrong and Mary Ann wife of said Samuel in the right of said Mary Ann, Samuel C Bassett and Esther wife of said Samuel C in the right of said Esther, and Joshua Bodwell, heirs and legal representatives of Mary Bodwell, late of Lodi Township, in the State of Ohio, deceased, for divers good causes, and in consideration for the sum of one dollar, in hand paid by Robert P Bodwell the receipt thereof is hereby acknowledged, have bargained and sold by these here presents do bargain, sell, devise, release, convey, assign, relinquish and quit claim unto him the said Robert P Bodwell and his heirs and assigns forever all of the estate right title, property, claim in law or equity, as heirs of the said Mary Bodwell, or otherwise in or to the following described tract or parcel of Ministerial or Leasehold land in Section No. 29, originially granted by Congress for the support of Religion in Town 4, Range 13, in the Ohio Company Purchase in Lodi Township aforesaid being Lot numbered Three (3) in said Section No. 29 on the plan of the said section made by Josiah Burroughs containing eighty acres more or less being the West half of the South East Quarter of said section, and was leased and devised by the Trustees of said original Town No. 4, Range 13 on the 28th day of February 1823 to Samuel Jones for the term of ninety nine years, renewable forever, and by said Samuel Jones conveyed to Thomas Jones, and said Thomas Jones conveyed to Mary Bodwell by assignment written on the back of said original Lease which has been since destroyed by fire. To have and to hold the promises to him the said Robert P Bodwell and his heirs and assigns forever in as full and ample a manner as we could hold or possess the same as heirs of the said Mary Bodwell deceased or otherwise howsoever, subject to the conditions and reservations of rents in the said original Lease contained and expressed. In testimony whereof, we the said grantors have hereunto set our hands and seals this twenty ninth day of August AD 1839.

     There follows the usual "so and so appeared before me" in Feb, March, and August 1840. Then 5 Sep 1840, Robert P Bodwell assigns the Lease to Elijah Tucker for $800 (Robert's wife is Lucinda).
